Sellers/realtor lied on cut sheet and property disclosure statement. Can I file a complaint?
The sellers/realtor lied on the house cut sheet saying the basement was finished when it clearly wasn't. Our realtor said it wasn't a big deal and that if we loved the house to put an offer in and reduce the price to reflect this. So we did.
The original property disclosure form came through and it all looked great. Come inspection time it turns out the septic system is shot and not working and needs to be replaced, meaning the house doesn't have a functioning sewage system at the moment. During the inspection, the house tenant informed us that it already backed up into the basement and the seller was aware issues associated with the tank. The seller brought in a remediation company to deal with the situation.
This wasn't disclosed and both the seller and their realtor were aware of the situation. They said they felt it didn't need to be disclosed because it was an issue caused by the tenant and not the house itself. They also claimed it was greywater and not sewage but I called the remediation team that did the cleaning and they said that it was 100% sewage and the seller would have been aware of that.
I'm annoyed beyond belief because if we had seen this on the property disclosure form we likely would have approached this house differently. Can I file a complaint against the realtor for incompetence and failing to disclose information?
