residents management company
Hi just after some advice -
Purchased new build last October from a small developer. It states that when all properties were sold the management company (which is currently in the builders name) is set up, it will be transferred to the residents. So here's the thing - The last house completed in April. So far we've heard nothing. The builder is being fairly shady about it all. The weeds in the carpark are sky high, there's also the issue of a septic tank that serves all 11 houses. This has been in use for a year now so really needs emptying but of course noone has paid anything for maintenance yet and the builder is now saying it's not his problem anymore and we should all just club together and pay for it.
Is he in breach of contract here? As he is still the director of the management company at present? The other issue is that if we decided to go ahead and empty it, how would we collect the money from every house? As there's bound to be some people that aren't compliant..
