NC-Buying a house with an open septic repair permit?

First time home buyer. Put an offer in on a house built in 1975. FHA loan. Passed inspections, inspector noticed a bit of a drainage issue in the yard. We went and checked it out on the last day of due diligence after a heavy rain, the entire back yard was marshy. Pushed forward (our bad, I know) but hired a septic engineer and later a soil scientist to figure out what was up, and they recommended a complete replacement at $20k. Tank has root intrusion and holes, is not draining into the proper field. We look into it and there is a permit open since 2018 for a repair, buyers routed drainage into the stream in the back yard, did not repair the tank. So effluent has been running into the yard and into the stream. They failed an inspection but opted not to do any further repairs, just "reduced their water usage". Agent has encouraged us to just accept repair costs (in the form of a check to the septic contractors) at closing. Really pushing us to close. In order for the sale to go through, we had to accept the $20k, raise the purchase price, and accept closing costs. I'm concerned it will be brought up in underwriting and we won't be able to close anyway, but she said the attorney didn't mention there being an issue. The whole situation really sucks for us, we can't afford to replace the tank as well as deal with other necessary updates up front. Anyway. We're stressed as hell. They want us to close on Monday. Any insight would be great.
